Design Assistance Liability Waiver Agreement
“Design Assistance” by Experienced Brick & Stone, LLC (hereinafter EBS) is any and all advice, sketches, specifications, drawings and/or pictures provided to the Client for the purpose of helping the Client or his/her agents design the Client’s project. Design Assistance is provided as a gratuity and no-cost service. Design Assistance is not to be construed as professional design services. The Client understands that EBS is not an architect or engineer, and any Design Assistance provided is explicitly disclaimed from being architecture, engineering, or any other professional service. EBS makes no warranties whatsoever – neither express nor implied – with respect to any Design Assistance provided.
Idenmnification / Liability
Client agrees to indemnify, save and hold harmless EBS from any and all damages, liabilities, costs, losses or expenses arising out of any claim, demand, or action by a third party arising from the use of the Design Assistance in this Agreement.
Release of Liability
The Client hereby releases EBS, its employees and agents, from all liabilities, claims, demands, and causes of action that arise in any way from any personal injury, injury to property, failure, damage, loss, or any other circumstance arising from or in any way related to the Design Assistance. This release specifically includes claims for the negligence of EBS and claims for strict liability. This release does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that New York law does not permit to be excluded by agreement.
